Where the use of Tamasha website by any person, whether a consumer, a merchant, or otherwise, constitutes his approval and acceptance, in full legal capacity considered in Sharia, the system and the law, of all the materials, items and provisions of this agreement, and is an affirmation of your commitment to its systems and what is mentioned therein. We inform you that Tamasha website is an (electronic website) and this agreement is effective and enforceable upon your approval and start of registration on Tamasha website.
Article 1 - Introduction Definitions:
The above preamble is an integral part of this agreement, and you will find below the meanings and definitions of the key terms used in this agreement:
Tamasha Website: This phrase refers to Tamasha website on the web, and this definition includes all forms of Tamasha Travel and Tourism Company on the web.
(Service Provider) This phrase refers to any service provider who registers on Tamasha website to manage their commercial activity, whether they are a tour guide or an entrepreneur in the tourism sector. This definition includes all aspects of the site as long as they benefit from the services provided through Tamasha website
(Service Provider Account) This phrase refers to the account used by a service provider on Tamasha website.
(Consumer) This phrase refers to any consumer who benefits from the services provided by the service provider through Tamasha website.
(Agreement) This phrase refers to the rules, terms and conditions for using Tamasha website, meaning all the provisions and terms of this agreement, which govern and regulate the relationship between the parties to this agreement (the service provider and Tamasha website).
(Commercial Activity Account) This phrase refers to any commercial activity in the tourism sector that is added to Tamasha website.
Article 2 - Legal Capacity of the Service Provider:
The service provider acknowledges that he/she has legal capacity considered in Sharia and the law, that he/she is at least eighteen years old, as considered in the laws and regulations in force in the Kingdom of Saudi Arabia, and that he/she has sufficient knowledge to create, establish and manage his/her account on Tamasha website.
In the event that the service provider registers as an establishment or company, or any other organizational form, then this establishment or company or organizational form that is registered through it must have the necessary legal, regulatory and legal capacity to carry out business through Tamasha website.
The service provider agrees that in the event of his/her violation of this article "Legal Capacity of the Service Provider", he/she shall bear the consequences of this violation before consumers or users or others, as Tamasha website has no legal, regulatory or legal relationship with the service provider's dealings with the consumer or others. It also has the right to hold the service provider accountable under the provisions of contractual liability, and to demand compensation for any damages that may arise as a result of this violation, including any damage to Tamasha website's reputation before other service providers, consumers or users, or before others.
Article 3 - Nature of Tamasha Website's Obligations:
Tamasha Website's role is limited to providing marketing services, attracting customers, providing e-commerce channels, and sales management tools by adding the activity to Tamasha Website. Tamasha Website's obligation under this agreement is only to create an electronic account for the commercial activity on Tamasha Website and to place the commercial activity in front of users.
Tamasha Website may provide other services to the service provider, or the service provider account may provide marketing support services or guidance and counseling services, as well as provide electronic payment gateways over the Internet. All Tamasha Website services are subject to the terms, conditions and provisions of this User Agreement.
Tamasha Website is not obligated to complete payment transactions between the consumer and the service provider. Its obligation ends with the creation of an electronic account for the commercial activity on Tamasha Website. This does not prejudice the other services that Tamasha Website continues to provide, such as guidance, counseling, technical support, marketing, and payment methods.
Tamasha Website may temporarily provide some free services for some commercial activities, such as:

Marketing commercial activity content on social media platforms (TikTok, Instagram, and X).

Adding commercial activity to the trending list on Tamasha Website.
These services are provided by the Tamasha Website administration for free and on a limited basis and are subject to specific and specific restrictions. If the service provider wants additional services, he must contact the technical support of Tamasha Website to inquire about offers, package fees and additional services.
All transactions that take place between the service provider and the consumer have nothing to do with the person of Tamasha Website, and Tamasha Website is not responsible for them. This transaction is an independent contractual relationship that is subject to the agreement concluded between the service provider and the consumer. Accordingly, if the consumer fails to pay the price of the service provided by the service provider, Tamasha Website has nothing to do with these violations.
Tamasha Website is considered a technical website on the Internet that allows the service provider who agrees to this agreement to establish an account for his commercial activity on Tamasha Website and to practice his activity through the website. Its mission ends at this point. There is no minimum responsibility on Tamasha Website for the violations committed by the service provider in his account on the website in violation of the provisions of this agreement, and Tamasha Website has no relationship to the transactions that take place between the service provider and the consumer.
Article 4 - Controls for Creating a Commercial Activity Account on Tamasha Website:
Any person who has the legal capacity considered valid by the system and law may create a commercial activity account in accordance with the rules and provisions of the User Agreement, and in particular "Article 2 - Legal Capacity of the Service Provider".
The commercial activity account that has been established in accordance with the Tamasha Website User Agreement must not be in violation of the systems and laws in the Kingdom of Saudi Arabia. The service provider is obligated to clarify the nature of the work he adds to Tamasha Website, the nature of the services he provides, and Tamasha Website disclaims its responsibility for the service provider's violation of the provisions of the systems in the Kingdom of Saudi Arabia and public morals. Tamasha Website always has the right to refuse to register any commercial activity that does not comply with the laws and regulations in force in the Kingdom of Saudi Arabia or the provisions of this agreement. Therefore, the service provider acknowledges, under the provisions of the agreement, that his commercial activity does not violate the public order in the Kingdom of Saudi Arabia or Islamic morals.
The services of the commercial activity added to Tamasha Website must not violate the rules and provisions of this User Agreement. The service provider also acknowledges that the place of business on which the transaction in the commercial activity account on Tamasha Website is not in violation of this agreement and is not in violation of the systems and laws in force in the Kingdom of Saudi Arabia.
No person is entitled to use Tamasha Website as a service provider if his membership or commercial activity account has been canceled by Tamasha Website or by virtue of orders or judicial rulings.
In the event that any service provider registers as an institution, company, charity, or legal entity, the registered institution, company, or entity shall be bound by all the rules and provisions mentioned in the Tamasha Website User Agreement.
All service providers and commercial activity accounts must comply with all applicable laws and regulations governing e-commerce, as well as the Information Crimes System, the Ministry of Commerce and Investment Systems, the Electronic Transactions System, and the E-commerce System.
All service providers and commercial activity accounts must disclose the following information in the commercial activity account on Tamasha Website:
Name and address - Commercial register or tourist guide license and other licenses required for the activity - Official means of communication.
All service providers and commercial activity accounts must disclose the terms and conditions to the consumer, the privacy policy, and information confidentiality, which are considered an electronic contract.
All service providers and commercial activity accounts must provide the consumer with an invoice showing the costs of purchasing the provided service, the total price, the date and place of booking, and the exchange and return policy.
All service providers and commercial activity accounts that provide certain services that require a license from the official authorities must disclose the license and all data.
All service providers and commercial activity accounts that hold a commercial register for their premises must register the electronic store with the commercial register of the establishment in accordance with the system.
The service provider acknowledges that before registering on Tamasha Website, he has verified that all the procedures and requirements required by the official authorities in the Kingdom of Saudi Arabia are available and has fulfilled all these procedures and requirements to practice his activity through Tamasha Website.
All service providers and commercial activity accounts wishing to register on Tamasha Website and engage in e-commerce on the site must have an existing commercial register or freelance document, in addition to fulfilling other regulatory requirements and issuing the necessary licenses related to the practice of service providers' commercial activities through Tamasha Website.
In the event that the service provider applying to join and create a commercial activity account is an individual service provider ("natural person"), he is also obliged to verify the requirements required by the official authorities and provide them according to the nature of his activity, where the individual service provider acknowledges that he is committed to these requirements and is committed to providing and preparing them. The individual service provider is also obliged to provide his national identity data in addition to the data of the freelance document and other necessary information and documents that Tamasha Website requests.
In the event that the service provider applying to join and create a commercial activity account on Tamasha Website represents a commercial establishment, company, charity or legal entity, it must provide Tamasha Website with all information and supporting documents, such as the commercial register and any other commercial activity documents that Tamasha Website requests for registration and proof of the legal personality of the commercial activity.
The service provider and the commercial activity account must comply with the registration obligations specified in "Article 5 - Accounts and Registration Obligations", and all the rules and provisions of the User Agreement.
In the event of non-compliance with any of the foregoing, Tamasha Website management has the right to take any of the following measures, which are not limited to: warning, suspending the service and closing the commercial activity account, or blocking you from accessing the sales management interface on Tamasha Website again as it deems appropriate. However, Tamasha Website is not legally or religiously responsible for this breach by the service provider vis-à-vis the consumer, as it is not a party to the relationship between the consumer and the service provider, but rather does so in order to improve the quality of Tamasha Website and the service providers present on the site.
Article 5 - Accounts and Registration Obligations:
Upon submitting a request to join Tamasha Website or a request to create a commercial activity account on the website, you will be required to disclose specific information and choose a username and password to be used when accessing Tamasha Website. After activating your account, you will become a service provider and a beneficiary of Tamasha Website services, and you will have agreed to:
Be responsible for maintaining the confidentiality of your account information and password, and agree to notify Tamasha Website immediately of any unauthorized use of your account information on Tamasha Website or any other breach of your confidential information.
Tamasha Website will not be liable in any way for any loss that may be caused to you, directly or indirectly, moral or material, as a result of the disclosure of username or password information or in the event of misuse of the commercial activity account.
You agree to use your commercial activity account yourself, as you are fully responsible for it. If someone else uses it, this means that you have authorized them to use the account in your name and on your behalf, unless the service provider has notified Tamasha management otherwise.
You agree to use Tamasha Website in a serious and credible manner when using it, and to comply with the rules and provisions of the User Agreement and the regulatory and legal controls in force in the Kingdom of Saudi Arabia. You are considered obligated to compensate Tamasha Website for any direct or indirect losses that may be incurred by Tamasha Website as a result of any illegal, untrue, or unauthorized use of your account by you or by any other person who has obtained access keys to your account on the site, whether to perform services using the username and password or as a result of your negligence in maintaining the confidentiality of the username and password, whether with or without your authorization.
You agree to disclose true, accurate, up-to-date, and complete and legal information about yourself as required during registration with Tamasha Website.
You agree to update your personal data on the site if it changes in reality or if necessary.
You agree not to include any of your contact details, such as email addresses, phone numbers, or any personal details, or any phrase that indicates a personal or commercial relationship between you and Tamasha Website or its affiliates or owners, in your username.
You agree not to put anything in your commercial activity account that indicates a direct or indirect relationship between the commercial activity and Tamasha Website or its management, owners or affiliates, as Tamasha Website has no relationship with and is not responsible for your commercial activity.
Tamasha Website is committed to treating your personal information and contact details confidentially in accordance with the provisions of the Privacy Policy and Confidentiality of Information in force on Tamasha Website.
You are obligated to maintain and update your registration data at all times to keep it true, accurate, up-to-date, complete, and legal. If you disclose information that is untrue, inaccurate, outdated, incomplete, illegal, or in violation of the User Agreement, Tamasha Website has the right to suspend, freeze, or cancel your commercial activity account on the site, without prejudice to Tamasha Website's other rights and legitimate means to recover its rights and protect other users.
Tamasha Website has the right at any time to conduct any investigations it deems necessary, and to request you to disclose any additional information or documents, no matter how large, to prove your identity or ownership of your funds or your account.
In the event of non-compliance with any of the foregoing, Tamasha Website management has the right to suspend or cancel your commercial activity account or block your access to Tamasha Website services again. It also reserves the right to cancel any unverified or unproven accounts or transactions or accounts that have been inactive for a long time.
Article 6 - Electronic Communications and Official Means of Communication:
The service provider agrees to be communicated with via email, or by Tamasha Website management broadcasting general messages that go to all users or to specific users when they log into their accounts within Tamasha Website. The service provider in Tamasha Website also agrees that all agreements, announcements, statements, and other electronic communications that he provides are equivalent to their written counterparts, and are self-explanatory, in meeting legal requirements.
Tamasha Website will send promotional emails during the period of adding your activity to the site to inform you of any new changes, procedures, or promotional activities that may be added to Tamasha Website.
Article 7 - Amendments to the Terms of Use and Fees:
You acknowledge and agree that Tamasha website will notify you of any amendments to this agreement, and accordingly, your obligations may increase or your rights may decrease in accordance with any amendments that may be made to this Terms of Use agreement.
You agree that Tamasha website has the sole and absolute right, without legal liability, to make any major or minor amendments to this agreement, and users will be notified of such amendment by any technical means available, such as email, a general broadcast to all users, or WhatsApp. Tamasha website provides technical means to demonstrate the acceptance of this amendment by the business, and such acceptance shall be legally valid, without prejudice to knowledge, and binding on the business to the provisions of the agreement, including any amendments.
In the event of an objection to any amendment to the Terms of Use, this may constitute an obstacle to accessing the business account, as in order to benefit from Tamasha website services, this agreement must be approved, as well as any amendments that may occur to it. Therefore, in the event of not accepting the amendment, Tamasha website hopes that you will stop using its services, as simply accessing your account on Tamasha website or using Tamasha website constitutes your acceptance of the amendments and full and complete approval without prejudice to knowledge. Tamasha website is happy to answer your inquiries about this agreement and receive any suggestions that the service provider deems necessary.
All fees are calculated in Saudi Riyal, and the service provider must pay all due fees on the website, in addition to any other expenses added by Tamasha website. Payment shall be made through the approved, specified, and available means on Tamasha website.
Not all Tamasha website packages and offers are free for service providers and businesses, as some of these packages and offers are subject to varying fees.
Tamasha website may impose fees on service providers, and this depends on the offers or packages they subscribe to.
Tamasha website reserves the right to add, increase, decrease, or discount any fees or expenses in accordance with the rules and provisions of the Terms of Use, on any of the users, regardless of the reason for their registration.
Article 8 - Payment and Settlement Services for Service Providers on Tamasha Website:
Tamasha website, through its partners, provides an online payment and settlement system on the website. This can be done entirely online through the payment options available on Tamasha website or through any payment method that Tamasha website offers from time to time.
Tamasha website may stipulate at any time and under any circumstances that payments be made directly between the service provider and the consumer, through their private bank accounts, and there is no relationship whatsoever to Tamasha website in this case.
Tamasha website provides the online payment service through the platform for the purpose of facilitation and preserving the rights of service providers.
The service provider is obligated to determine the price of the service they are offering in their business account in accordance with the recognized market value.
Tamasha website has no relationship whatsoever with any underestimation of the cost of products or services offered in the business account on Tamasha website.
Determining the price in the commercially recognized form is an obligation that falls on the merchant.
The service provider is obligated to provide invoices, receipts, and delivery notes for all amounts and profits generated in the business account.
The service provider is also obligated to specify in all these invoices the type of service, its quantities, descriptions, and value.
Accordingly, the service provider is obligated to provide the required accounting specifications in the business account on the website, in application of the provisions of this agreement, and in consideration of the legal, economic, and commercial interests of service providers in this regulation.
In the event that the service provider violates the provisions of this clause, they shall be deemed responsible for any damages that may arise as a result of this violation
Tamasha website has the right to prevent the completion of any payment procedure that violates the rules and provisions of the Terms of Use or to cancel any purchase or sale order due to a technical or technological error on the site that resulted in a difference between the prices displayed on the platform and the market value of the product, including any loss to Tamasha website. Tamasha website is not responsible for those amounts.
Tamasha website management has the right to cancel, modify, or change any of the payment methods that it has made available on Tamasha website.
Article 9 - Your Personal Information and Transaction Details Information:
You agree to grant Tamasha website an unlimited, worldwide, perpetual, irrevocable, royalty-free, and sublicensable right to use any personal or other information or materials that you have provided or made available to Tamasha website or that you have announced on the website through your membership, including through the designated communication and registration forms, or through any emails or any of the communication channels available on the website. This is done for the purpose of achieving any of the interests that Tamasha website deems appropriate.
You are solely responsible for the information you have sent or published, and Tamasha website's role is limited to allowing you to display this information through Tamasha website and its advertising channels.
The confidentiality of business activity and service provider information is subject to the rules of Tamasha website's "Privacy Policy and Information Confidentiality".
Article 10 - Service Provider's Commitment to Comply with Laws and Regulations in the Kingdom of Saudi Arabia:
The service provider undertakes to comply with all laws and regulations in force in the Kingdom of Saudi Arabia in relation to its services and during its use of Tamasha website, and with the laws, terms, and conditions in force and governing the use of the Internet, the Terms of Use, and the Privacy Policy and Information Confidentiality Policy in force at Tamasha website.
In the event that any service provider violates any of the provisions of the first clause of Article 10, they acknowledge Tamasha website's right to take any of the following actions, which are not limited to:

Suspending the service and closing the business account

Refunding any outstanding amounts from electronic payments to consumers
Article 11 - Rights:
All content on Tamasha website, whether electronic or otherwise, written or non-written, including but not limited to: written and non-written texts - graphic designs - technical ideas - slogans - offers - button icons - symbols - audio clips - aggregated data and software, are the property of Tamasha website and its rights are reserved for Tamasha website, and no one has the right to use them in any way, whether directly or indirectly or through a third party.
Tamasha website management warns that it will take the necessary action against any infringement or encroachment on any of Tamasha website's rights or intellectual property.
Tamasha website is not responsible for any infringement of intellectual property rights owned by service providers who are members of the site or commercial activity accounts registered with it.
Article 12 - Intellectual Property:
Tamasha website management respects the intellectual property rights of service providers that they have created through their commercial activity accounts, whether owned by them before adding the commercial activity to the store site or after adding it.
The service provider respects the intellectual property rights of Tamasha website, which include Tamasha website itself, the words, slogans, and other symbols of Tamasha website or displayed on Tamasha website, as Tamasha website, and any right attached to Tamasha website, are rights protected by intellectual property rights and trademark laws and are the exclusive property of Tamasha website and may not be infringed upon or used in any way without authorization from Tamasha website management.
Article 13 - Consumer:

However, Tamasha website is not legally or religiously responsible for this breach by the service provider towards the consumer, as it is not a party to the relationship between the consumer and the service provider, but rather does so for the purpose of improving the quality of Tamasha website and the service providers present on the site.
Consumers are required to review their purchases before receipt to ensure that they are intact and match what was purchased, as Sala Platform is not responsible for the relationship between the consumer and the merchant.
The consumer acknowledges, with full knowledge of the facts, that they are browsing the electronic commercial activity account based on their personal desire and are making a purchase from Tamasha website on their own personal responsibility.
The consumer understands and acknowledges that the commercial activity does not have an independent legal entity separate from Tamasha website. All commercial activities registered on Tamasha website have their own commercial register or freelance work document for practicing e-commerce or tourism guidance.
Tamasha website is not obligated in any way under this article and this clause to take any action in response to a consumer complaint. Rather, the website's response to a consumer complaint is subject solely to the discretion of Tamasha website and according to what the website deems appropriate,In accordance with the terms of this agreement and to protect its commercial and economic interests and reputation, Tamasha website may take certain actions against businesses that intentionally deceive, mislead, or defraud consumers. These actions may include:

Freezing the business account

Issuing a warning to the business not to repeat the offense

Requiring the business to compensate the consumer
Tamasha website is committed to protecting the rights of all its users and registrants.
Article 14 - Tamasha website's responsibility towards consumers and merchants:
Tamasha website is not responsible in any way for any unsatisfactory or delayed performance by businesses, electronic payment gateways, or banks, or for the failure of consumers to pay. Tamasha website is also not responsible for any losses, damages, or delays, due to or lack of quality of service provided by businesses
Tamasha website is not liable for any claims arising from errors or negligence, whether direct, indirect, incidental, or by a third party.
Tamasha website is not liable for any claims or responsibilities arising from financial losses, reputational damage, slander, or any damages arising from misuse or abuse or inability to use Tamasha website. Tamasha website does not assume any responsibility or claims in such cases.
Tamasha website, its officers, affiliates, and owners are not responsible for any claims, disputes, costs, damages, or any liability or any direct or indirect losses to any party arising from an act by a user of the site.
Tamasha website, its affiliates, owners, representatives, and agents are not responsible for any liability related to a service that is legal, legitimate, and authorized under the laws and regulations of the Kingdom of Saudi Arabia and is used for illegal or irregular purposes. No person or entity has the right to claim against Tamasha website for any claim, demand, or compensation in respect of the aforementioned misuse, as all services provided on the Tamasha electronic website are provided through service providers and businesses.
Tamasha website, its affiliates, owners, representatives, and agents are not responsible for any illegal or irregular activity carried out by the service provider and the business account listed on Tamasha website, or any activity that violates the systems and instructions in force in the Kingdom of Saudi Arabia. Tamasha website's responsibility is limited to providing sales and marketing management tools (as mentioned in Article 3), which is represented by adding the business to Tamasha website and the subsequent electronic and marketing support services.
Tamasha website management informs all service providers that if it notices any suspicious activities that are being planned, are being carried out, or have been carried out on Tamasha website, it will report these activities to the competent authorities. It is in no way responsible for these violations that occur without the knowledge or observation of Tamasha website.
Article 15 - Confidentiality of Information:
Tamasha website informs you that the World Wide Web (Internet) is not a secure environment, and the confidentiality of personal information cannot be 100% guaranteed on the Internet.
Tamasha website takes high-quality (tangible, organizational, and technical) standards to protect users and consumers, prevent unauthorized access to users' personal information or commercial activity accounts, and store it securely.
Tamasha website has no control over the actions of any third party, such as other websites linked to the site or third parties claiming to represent you or others
You acknowledge and agree that Tamasha website may use the information you have provided to it for the following purposes:

Article 16 - Replacement and Return Policy:
Commercial activity accounts can use Tamasha website for a free trial period of 90 days. After the trial period ends, an administrative fee of 499 Saudi Riyals is charged, which is payable once. This administrative fee can be refunded within 48 hours of payment confirmation. No refunds will be issued for any reason after 48 hours.
you can cancel your subscription to the Recommended List service and get a refund within 48 hours of confirmation of subscription.
you can cancel your subscription to the Tamasha Tables Recommendation service and get a refund within 48 hours of confirmation of subscription.
You can cancel your subscription to the WhatsApp or Email marketing service and get a refund within 24 hours of confirmation of subscription. Please note that bank transfer fees may apply, as determined by your bank and Tamasha website. Refunds will be processed to your registered bank account every 7 days.

"In relation to the consumer, Tamasha website has no connection to any return or exchange policy between the consumer and the service provider."
Article 17 - Suspension or Cancellation of Consumer Accounts or Commercial Activity Accounts:
Tamasha website, in accordance with the User Agreement and the laws and regulations in force in the Kingdom of Saudi Arabia, may resort to temporarily or permanently suspending commercial activity, withdrawing and canceling commercial activity accounts or consumer accounts, or limiting the service provider's access to Tamasha website services, in the following cases:
Violation of the terms and conditions of the User Agreement.
Verbal or written abuse, assault, or threats by any means whatsoever, whether directly or indirectly, from the service provider, members of their commercial activity, or any of the consumers, towards Tamasha website or any of its partners, members, or representatives.
If Tamasha website cannot verify any of the user information provided to it.
If Tamasha website determines that the user's activities are illegal or that the user's activities may cause trouble or legal violations for other users or Tamasha website.
Tamasha website may, "at its discretion," reinstate suspended users. However, a user whose account has been permanently suspended or canceled may not be able to register or restore their account on Tamasha website or use the site in any way whatsoever, under any circumstances, until their account is reactivated by Tamasha website administration. Nevertheless, if the user violates this User Agreement, Tamasha website reserves the right to recover or claim any sums due to Tamasha website from the user and any losses or damages caused by the service provider to Tamasha website. Tamasha website also has the right to take legal action or resort to the judicial authorities in the Kingdom of Saudi Arabia against the user as Tamasha website deems appropriate.
Tamasha website does not waive its right to take appropriate action against any violation of the terms and conditions of the User Agreement and other similar violations. Likewise, Tamasha website is not obligated to take any action against any violation of the User Agreement, and any such action is subject to the discretion of Tamasha website management and its legal department.
Article 18 - Account Closure Request:
Service providers have the right to request the closure of their accounts registered in the Tamasha website's database. When submitting the request, they must provide certain documents, including but not limited to:
A closure request form signed by the authorized store representative and verified by the official authorities.
Tamasha website reserves the right to accept or reject the closure request and to claim any rights or financial dues owed by the service provider
Without prejudice to the provisions of Article 16 of this Agreement, if a service provider requests the closure of their account, the service provider will not be eligible to receive a refund for any active subscriptions.
Article 19 - Payment and Sales Processes:
The service provider is obliged to manage their account well, in a way that preserves the rights of the consumer and does not create a dispute between them and the consumer.
The service provider is obliged to manage the payment and sales processes that take place in their account through the payment methods stipulated in this agreement.
Tamasha website has the right to refuse, cancel, or suspend purchases whether or not payment has been made.
Tamasha website would like to point out that it has no connection with any dispute that may arise between the consumer and the service provider, and Tamasha website is not responsible for any default on the part of the consumer towards the service provider, whether in terms of non-payment or otherwise.
The service provider agrees and acknowledges that they will not engage in fraudulent or manipulated purchases on Tamasha website. They will not use a fake name or any false personal information, nor will they use a credit card that does not belong to them without authorization to purchase. Tamasha website has the right to take appropriate legal action against anyone who engages in such fraudulent activities.
All service providers and accounts acknowledge that they are fully aware that the management of Tamasha website's transfer of funds for its commercial activities within Tamasha website is subject to the authority and powers of the Central Bank of Saudi Arabia. As a result, Tamasha website informs all service providers and accounts that there may be delays in transferring some funds due to restrictions imposed by the Central Bank, the Ministry of Commerce and Investment, and e-commerce regulations on electronic buying and selling operations.
Tamasha website reserves the right to impose any fees on service providers or accounts for their activities within Tamasha website. These fees may include, but are not limited to: government fees, bank fees, administrative fees, or any other fees that Tamasha website may be required to pay as a result of the activities of the service provider or account.
Article 20 - Prohibited Content and Products:
As a service provider on Tamasha, you are committed to not allowing any content that violates the Privacy and Information Confidentiality Policy or violates the terms and conditions of this User Agreement or the regulations in effect in the Kingdom of Saudi Arabia to be advertised or published through your business activity account.
Tamasha website strictly prohibits the sale of the following products and services, including but not limited to:

Any product/service that involves gambling, lotteries, or random items.

Any product/service that may cause any physical or psychological harm in any way.

Any pirated content or subscriptions and anything that violates intellectual property and copyright rights.

Any sexual or pornographic product/service or that promotes such content.
Article 21 - Saudi Anti-Cybercrime System:
The service provider and users are obligated to not violate any of the provisions of the Saudi Anti-Cybercrime System. In the event of any violation of the provisions of the Saudi Anti-Cybercrime System, they shall bear full responsibility for their actions and management. Tamasha website shall not bear any responsibility for any violations committed by the service provider of the applicable regulations. The service provider is solely responsible for their account and their dealings with consumers. Tamasha website reserves the right to take any action it deems appropriate against any service provider who violates the provisions of the Saudi Anti-Cybercrime System, whether by reporting them to the official authorities or by closing their electronic store or canceling their membership on Tamasha website.
Article 22 - Restriction of Access or Membership:
Without prejudice to the rights of other service providers, Tamasha website may suspend or cancel a business activity account or restrict a service provider's access to Tamasha website services at any time and without notice for any reason, without limitation.
Article 23 - Warranty:
Tamasha website does not guarantee that the services provided by the service provider are free from any other defects. The warranty, if any, is solely provided by the service provider and covers their business activity, as described in the product description. The service provider is obligated to maintain high quality standards in their business activity.
Article 24 - Service Provider's Responsibility:
The Service Provider agrees to assume responsibility and indemnify Tamasha website, its affiliates, owners, or subsidiaries from any harm that may befall Tamasha website as a result of the Service Provider's violations.
The Service Provider also undertakes to:
Remediate or prevent any harm that may be caused to Tamasha website, its affiliates, or any of them as a result of claims, losses, damages, costs, expenses, or fees arising from the misuse of the Service Provider or the misuse of the user, which results in a breach of the User Agreement or the systems and laws in force in the Kingdom of Saudi Arabia, or an infringement on the rights of any merchant or third party, or a complaint from a user or third party.
Article 25 - Relationship and Notices between Tamasha Website and the Service Provider:
None of the terms and conditions of this User Agreement shall imply the existence of a partnership between any Service Provider and Tamasha website. Tamasha website shall not allow any Service Provider in any case to directly or indirectly suggest or dictate the existence of any relationship whatsoever, whether direct or indirect, between it as a Service Provider and Tamasha website or its management.
And any notices that the Service Provider wishes to send to Tamasha website must be sent via WhatsApp, and Tamasha website will respond to the email. And you, as a Service Provider, agree that any notices sent to you from Tamasha website will be delivered to you via the WhatsApp number that you provided to Tamasha website during the registration process.
Article 26 - Governing Law and Legislation:
This User Agreement is governed by and construed in accordance with the laws, regulations, and statutes in force and effect in the Kingdom of Saudi Arabia, and is fully and completely subject to the legislation in force in the Kingdom of Saudi Arabia.
Article 27 - Rules that the Service Provider must follow when dealing with the consumer:
The Service Provider undertakes to adhere to honesty, integrity, and fairness in its dealings with the consumer.
The Service Provider undertakes to adhere to good morals in its dealings with the consumer.
Article 28 - Tamasha Website's Print and Electronic Promotional Publications and Special Offers:
The terms and conditions of this User Agreement shall apply to all print and electronic promotional publications across various publishing platforms and across various social media channels.
The publications are subject to change and do not obligate Tamasha website with regard to the stability of service prices or packages or offers. Price changes are subject to changes that occur on Tamasha website or its service providers.
Any offers made by Tamasha website are temporary offers and are specified for a specific period of time. Tamasha website is not obligated to extend the time period or continue the specified time period, as it has the right to suffice or determine the eligibility of any user for this offer or cancel this offer at any time.
Article 30 - Technical Support:
Pursuant to the terms and conditions of this User Agreement, Tamasha website provides some technical support services to the Service Provider, in accordance with the privileges of the package that the Service Provider subscribes to. These services may include, for example:
A free control panel for the Service Provider, which includes some free services.
If the Service Provider wishes to add some services or different services or multiple services, this is subject to Tamasha website's package policies and offers, which are often subject to fees.
Tamasha website allows the Service Provider the right to communicate with Tamasha website's technical support team, which helps the Service Provider's work through the website and resolves any electronic technical issues that may arise for the Service Provider
Article 31 - Dispute Resolution:
Pursuant to the terms and conditions of this User Agreement, in the event of a dispute, the dispute shall be resolved through conciliation and negotiations or amicable settlement. If the dispute persists, it shall be resolved by the competent authorities in the Kingdom of Saudi Arabia.
Article 32 - Policy for Receiving Consumer Complaints and Settling Disputes Between the Consumer and the Service Provider:
Tamasha website requests that in the event of a complaint against a consumer or one of the service providers, the following steps be followed:
Step 1: Submit a complaint through the dedicated link on Tamasha website. The complaint must include:

The text of the complaint and its supporting documents

The name of the offending service provider
Tamasha website will then refer the complaint to the relevant service provider for resolution.
Step 2: The consumer has the right to take whatever action they deem appropriate after reviewing the content of the service provider's response to the complaint. If the consumer is not satisfied with the service provider's response, they have the right to request a copy of the service provider's legal identity to take whatever action they deem appropriate against the service provider
Article 33 - General Provisions:
If any provision or clause contained in this User Agreement is invalidated or becomes unenforceable, such invalidation or unenforceability shall not affect the validity or enforceability of the remaining provisions, clauses, rules, and conditions contained in this User Agreement, which shall remain in full force and effect until further notice from the Tamasha website management.
This User Agreement - which may be amended from time to time as deemed necessary - constitutes the mechanism for work, understanding, agreement, and contracting between the Service Provider and his account and Tamasha website only, and the Service Provider undertakes to comply with the provisions of this Agreement, and also agrees and acknowledges the following:
This User Agreement applies to all users of Tamasha website and governs the relationship, which is the contract, between the Service Provider and Tamasha website only, regardless of any organizational form, legal entity, institution, business, or charity that the Service Provider may take. As for the relationship between the Service Provider and the consumer, it is subject to an independent legal relationship and has its own special conditions that apply between them.
A Service Provider who joins Tamasha website through the "Success Partners" program (link to be inserted) grants the Success Partner who registered them the right to access information about the merchant and their store.
No person - other than Tamasha website management or the judicial authorities in the Kingdom of Saudi Arabia - has the right to impose any provisions, clauses, or any amendments to Tamasha website's User Agreement.
In the event of any amendments to this User Agreement, all Service Providers and users will be notified. If they continue to use the site, this will be considered acceptance of any amendments made to this Agreement.
This User Agreement may not be waived or amended except by a decision issued by Tamasha management.
